Terms of Service

1. Eligibility

You must be at least 16 years old (or the age of majority required in your jurisdiction) and able to form a binding contract. By using the Service you represent that you meet these requirements.

2. The Service

The Deliberate Week provides tools, structure, and organization to help you plan and run your personal life — including planning, capture, diagnostics, tracking, and reminders. The Service provides structure and organization only. IT DOES NOT PROVIDE FINANCIAL, INVESTMENT, LEGAL, MEDICAL, MENTAL-HEALTH, OR TAX ADVICE, and is not a substitute for a licensed professional. See the Disclaimer (Section 9) and our separate Disclaimer page.

3. Your account

You are responsible for your account, for keeping your credentials secure, and for activity under your account. Notify us promptly of any unauthorized use. We are not liable for losses caused by unauthorized use you could have prevented.

4. Subscriptions, billing, and cancellation

• Some features require a paid subscription or one-time purchase. Prices and what each tier includes are shown in the Service and may change on a prospective basis.
• Paid subscriptions are billed through our payment processor (Stripe) on a recurring basis (for example, monthly) and automatically renew until canceled. By subscribing, you authorize recurring charges until you cancel.
• You can cancel anytime; cancellation takes effect at the end of the current billing period, and you keep access until then. Except where required by law, payments are non-refundable and partial periods are not prorated. [ADJUST REFUND TERMS WITH COUNSEL.]
• We may offer free tiers, trials, or complimentary ("comp") access at our discretion, and may modify or end them prospectively.
• Failed payments may result in suspension or downgrade of paid features.

5. License to use the Service

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own personal life management, subject to these Terms.

6. Your Content

You retain ownership of the content you create in the Service ("Your Content"). You grant us a limited license to host, store, process, and display Your Content solely to operate and provide the Service to you (and to those you choose to share it with). We do not claim ownership of Your Content and do not sell it. You are responsible for Your Content and represent that you have the right to store it.

7. Acceptable use

You agree not to: use the Service unlawfully; infringe others' rights; upload malware; attempt to breach security, access other users' data, or circumvent access or payment controls; scrape or reverse-engineer the Service except as permitted by law; or use the Service to harm others. We may suspend or terminate accounts that violate these Terms.

8. Our intellectual property

The Service, its software, design, content, and our trademarks and methodologies — including but not limited to the Personal Operations Index (POI), the Personal Integration Index (PII), the Eight Dimensions (8D) framework, and related names and marks — are owned by us or our licensors and are protected by law. These Terms do not grant you any right to our trademarks or IP except the limited license to use the Service.

9. Disclaimer — not advice

THE SERVICE PROVIDES STRUCTURE AND ORGANIZATION, NOT ADVICE. It does not provide financial, investment, legal, medical, mental-health, or tax advice, and does not create any professional, fiduciary, or therapeutic relationship. Do not rely on the Service for professional decisions; consult a qualified licensed professional. In an emergency, contact your local emergency services. Any personalized financial advisory services, if and when offered, are provided only through a separately identified, appropriately registered entity under its own agreements — not through this Service.

10. Third-party services

The Service integrates third-party services (for example, payment processing and calendar features). Your use of them may be subject to their terms, and we are not responsible for third-party services.

11. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that it will meet your requirements.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain limitations, so some may not apply to you.

13. Indemnification

You agree to indemnify and hold us harmless from claims and expenses arising out of your misuse of the Service or violation of these Terms, to the extent permitted by law.

14. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or as needed to protect the Service or others. Sections that by their nature should survive termination (including IP, disclaimers, limitation of liability, and indemnification) survive.

15. Governing law and disputes

16. Changes to these Terms
